Our service and how to contact us
The Charter Desk LLC operates The Charter Desk website and connected-assistant service. Contact info@thecharterdesk.com with questions, complaints or requests for help. These terms govern use of those services. A particular booking is also governed by the written offer and applicable booking documents supplied before acceptance.
We act as an agency arranging travel services supplied by independent operators. A listing does not make us the owner or operator of the listed service. We remain responsible for our own services and for duties imposed on us by applicable law. The offer identifies the supplier and the parties with whom you are contracting.
Browsing and information
Our listings, search results, price ranges and assistant replies help you consider options. Availability, prices, descriptions and images can change and may originate with suppliers. An indicative result, saved shortlist or enquiry is not a reservation. Tell us about any feature or requirement essential to your decision so it can be checked for your proposed booking. We remain responsible for information and representations to the extent required by law.
Connected assistants and quote requests
You may use a compatible assistant to search our published information and ask us for a formal quote. Limited browsing is available without contact details. Fuller results may use a contact detail you choose to provide; a formal quote request needs an email address, phone number or an existing contact-session reference. Our privacy notice explains how this information is handled.
Only supply your own contact details, or information you are authorised to provide. Review the selected items, dates, group size and notes before instructing an assistant to submit. Do not send sensitive documents or payment-card details through the tools. Keep any contact-session reference private; it is not proof that the contact address has been verified.
A tool acknowledgement means the request has been received, not that a booking has been made, availability reserved, a contract accepted or payment taken. The desk handles the written quote and any necessary follow-up separately. A phone number alone does not authorise an unsolicited WhatsApp conversation; if that channel requires you to message us first, we will need that step or another suitable contact method.
Your chosen assistant is a separate service under its own terms. Its summary may omit or misstate information. Check the written offer and raise discrepancies with us before accepting. Listing our connection in an assistant does not make that provider a party to your booking.
Offers, prices and booking confirmation
Before accepting, read the dated offer, agency terms and supplier contract supplied for your booking. They identify the service, dates, contracting parties, inclusions, mandatory charges, payment recipient, payment schedule and steps for acceptance and confirmation. Any separate agency fee must be disclosed before acceptance. Agreed special requirements should be recorded in those documents.
The offer states the payable amount and currency, security deposit and required extras, and explains how a charge that cannot reasonably be calculated in advance will be determined. Display-currency conversions are indicative. Pay only by the method and to the recipient shown in your offer. Independently verify changed payment instructions using contact details you already trust. An enquiry or payment alone is not confirmation; follow the confirmation steps in the offer.
Changes, cancellation and refunds
Cancellation, change and refund arrangements are stated in the booking documents before acceptance and remain subject to applicable law. There is no universal cancellation scale in these website terms. If a change is proposed, contact us so we can explain the available options and who is responsible for any refund. A later update to these terms does not rewrite an existing booking.
Travel requirements and assistance
Check the passport, visa, passenger and qualification requirements applicable to your trip and the services you choose. Ask what operator insurance applies and consider suitable travel and cancellation cover. We do not promise cover that has not been confirmed. Activities and routes remain subject to the agreed contract, safety decisions and conditions at the time.
If a problem arises during a service, notify the operator promptly and contact us so we can help. Keep relevant records. These terms impose no short complaint deadline that removes a statutory right.
Fair use and content
Use the service lawfully and provide accurate information. Do not impersonate others, submit unauthorised requests, disrupt the service, bypass access controls or misuse personal information. Automated access must respect the service's published limits. We may limit or suspend access where reasonably necessary for security, misuse or maintenance; this does not remove existing booking or consumer rights.
You may use results for your travel planning and enquiry. Access does not grant a right to commercially redistribute supplier photographs or the catalogue, or to misrepresent a result as a confirmed offer. Rights provided by law remain unaffected. Report content errors or rights concerns to info@thecharterdesk.com.
Responsibility and applicable rights
We do not exclude responsibility for our own breach, fraud or any liability that cannot lawfully be limited. Independent operators are responsible for their services under their contracts and applicable law. Mandatory package-travel or linked-travel duties, if applicable to a particular transaction, take precedence over describing us as an agent.
Nothing in these terms deprives a consumer of mandatory legal protections or access to a court they are entitled to use. We may update these terms prospectively; the date above identifies this version. Contact us if you need the terms applicable to an existing booking.
Governing law and courts
These terms and disputes between you and The Charter Desk LLC arising from these terms or our website, connected-assistant or agency services are governed by the laws of the State of New Mexico, United States, together with applicable United States federal law.
If you are a consumer, this choice of law does not deprive you of protections under mandatory laws of the country or state where you habitually live that cannot be excluded by agreement. Nothing in these terms limits any mandatory right you have to bring or defend proceedings in the courts where you live, or requires you to bring a claim in New Mexico where applicable consumer law entitles you to use another court. We may bring proceedings against you only in a court permitted by applicable mandatory jurisdiction rules.
Subject to those consumer protections and any other mandatory jurisdiction rules, the state courts of New Mexico and the United States federal courts located in New Mexico, where they have subject-matter jurisdiction, have exclusive jurisdiction over these disputes, and you and The Charter Desk LLC agree to that jurisdiction and venue.
This clause does not change the governing law or courts specified in a separate contract with an independent operator, or retrospectively change an existing booking agreement. Those contracts remain subject to applicable mandatory consumer protections.
